EB-5 minimum investment amounts are scheduled to adjust on January 1, 2027.
The current statutory minimum is $1,050,000, or $800,000 for qualifying investments in a targeted employment area or infrastructure project. Federal law requires these amounts to adjust beginning January 1, 2027 and every five years thereafter.
The statute also states that the adjusted amounts apply to petitions filed on or after the effective date of the adjustment.
As of September 24, 2026, TADE has not identified an official government publication establishing the adjusted January 1, 2027 dollar amounts. This page will be updated when DHS publishes the official amounts.

Are EB-5 Investment Amounts Changing in 2027?
Yes. Federal law provides for the EB-5 minimum investment amounts to automatically adjust beginning January 1, 2027, with additional adjustments every five years thereafter.
The adjustment applies to the statutory investment thresholds used in EB-5. It is separate from the September 30, 2026 provisions that have generated questions about Regional Center grandfathering and from the Regional Center Program’s current authorization through September 30, 2027.
For the relationship among those dates, see September 30 vs. January 1: Understanding the Two EB-5 Dates.
What Are the Current EB-5 Investment Amounts?
As of September 23, 2026, the current statutory minimums are:
$1,050,000 for the standard EB-5 investment amount.
$800,000 for qualifying investments in a targeted employment area or infrastructure project.
These investment requirements apply to both standalone and Regional Center EB-5 investors.
The $800,000 amount should not be understood as the minimum for every EB-5 investment. The investment must qualify under the applicable statutory requirements for the reduced threshold.
Have the Official 2027 Amounts Been Announced?
Not yet, based on the primary government materials TADE has verified as of September 23, 2026.
The adjustment itself is required by statute. What has not yet been officially established in the government materials reviewed is the new dollar amount that will take effect on January 1, 2027.
TADE is therefore not presenting industry projections or independently calculated estimates as the official 2027 investment amounts.
When DHS publishes the official adjustment, this page will be updated with the new amounts and the applicable government authority.
How Does the January 1, 2027 Adjustment Work?
Congress established the adjustment mechanism in the EB-5 Reform and Integrity Act of 2022.
The statute does not require Congress to pass a new investment amount each time the thresholds change. Instead, it provides an automatic adjustment mechanism beginning January 1, 2027 and repeating every five years.
How Is the Standard EB-5 Amount Adjusted?
The standard amount is adjusted using the cumulative annual percentage change in the unadjusted Consumer Price Index for All Urban Consumers (CPI-U), U.S. city average, between January 1, 2022 and the adjustment date.
The resulting qualifying investment amount is then rounded down to the nearest $50,000.
This statutory formula establishes how the adjustment is determined. It does not mean that an unofficial calculation should be treated as the official January 2027 amount before DHS publishes the adjustment.
How Is the Reduced Qualifying Amount Adjusted?
Beginning January 1, 2027, the reduced qualifying investment amount adjusts to 75% of the adjusted standard investment amount.
That reduced threshold continues to depend on whether the investment qualifies for the lower amount under the EB-5 statute.
How Will the Official Amounts Be Published?
The statute directs the Department of Homeland Security to update the amounts through a technical amendment published in the Federal Register.
DHS has also discussed implementation of the investment-adjustment provisions in 2026 rulemaking, including updating the amounts on the USCIS website. That material is currently proposed rulemaking, however, and should not be treated as a final regulation.
That is an important distinction:
Statute: establishes the adjustment in enacted law.
DHS proposed rule: addresses proposed implementation and is not final regulation.
Federal Register technical amendment: will provide the official adjusted amounts as required by statute.
USCIS guidance: should be reviewed for implementation information as it becomes available.
Which Filing Date Determines Which EB-5 Investment Amount Applies?
The statute provides an unusually direct answer to this question.
The adjusted EB-5 investment amounts apply to petitions filed on or after the effective date of each adjustment.
For the upcoming adjustment, the effective date is January 1, 2027.
This filing-date rule is important, but it should not be expanded beyond what the statute actually says. Questions about when money was transferred, when an investment was made, whether funds were placed in escrow, when a targeted employment area is determined, or other eligibility requirements can involve separate legal and factual considerations.
What About Money Invested or Transferred Before January 1?
The statutory adjustment provision expressly addresses when the petition is filed for purposes of applying an adjusted investment amount.
That does not mean the petition filing date automatically answers every separate question concerning the timing or structure of the investment.
The 2026 DHS proposed rule contains additional proposed implementation language concerning the investment at the time an EB-5 petition is filed. Because that rulemaking is not final, TADE does not treat those proposed provisions as final regulatory requirements.
Individual funding and filing circumstances should be reviewed with qualified immigration counsel.
Does the 2027 Adjustment Apply to Direct EB-5?
Yes. The statutory investment requirements are not limited to Regional Center EB-5.
Congressional Research Service materials identify standalone and Regional Center EB-5 as the two investment pathways and state that the investment requirements are the same for both.
The January 1, 2027 statutory adjustment is therefore relevant to standalone Direct EB-5 as well.
The adjustment changes the applicable investment thresholds. It does not change Direct EB-5 into a Regional Center investment or otherwise eliminate the separate requirements of the standalone pathway.
For the broader structure and requirements of the standalone pathway, see TADE’s Direct EB-5 guide.
Does the 2027 Adjustment Apply to Regional Center EB-5?
Yes. The same statutory investment requirements apply to Regional Center investors.
The January 1 adjustment should not, however, be confused with the separate dates affecting the Regional Center framework.
Questions about September 30, 2026, January 1, 2027 and the Regional Center Program’s September 30, 2027 authorization date are explained in TADE’s 2026–2027 EB-5 timeline.
What Does January 1 Change, and What Does It Not Change?
| Issue | January 1, 2027 |
|---|---|
| Statutory minimum investment amounts | Adjustment takes effect |
| September 30, 2026 grandfathering-related provision | Separate issue |
| Direct vs. Regional Center structure | The pathways remain distinct |
| Job-creation requirement | Not eliminated by the investment adjustment |
| Other EB-5 eligibility requirements | Not replaced by the investment adjustment |
The January 1 event is fundamentally an investment-threshold adjustment. It should not be interpreted as a broader replacement of EB-5 eligibility requirements.
Readers researching the permanent standalone eligibility framework can review Direct EB-5 Requirements.
When Is the Next EB-5 Investment Adjustment After 2027?
The statute provides for automatic adjustment beginning January 1, 2027 and every five years thereafter.
Under that statutory schedule, the next adjustment after 2027 is scheduled for January 1, 2032.
That establishes the timing of the next adjustment. It does not establish what the investment amounts will be in 2032.
What Should Investors Watch for Before January 1, 2027?
The most important development will be the government’s publication of the official adjusted investment amounts.
TADE will monitor:
- DHS publication of the technical amendment in the Federal Register;
- USCIS publication of the official adjusted amounts;
- relevant final DHS regulatory action;
- USCIS implementation guidance.
Until the government publishes the official figures, TADE will continue to distinguish the current statutory amounts from projections of what the January 2027 amounts may become.
